1.1 These are the legal terms and conditions ("Terms of Service", "Terms"), which apply to the hosting services and products available from Push Button Hosting ("our service", "we", "our", "us") and to any correspondence between you and us. Please read these terms carefully before using our services.
1.2 Push Button Hosting is owned and operated by ESHOWCASE, INC., whose registered office is at 10785 W. Twain Ave. Ste 102. Las Vegas, NV, 89135, United States.
1.3 By subscribing to Push Button Hosting services, you agree to all of these Terms of Service.
1.4 These Terms form a legally binding agreement between us and you.
## 2. Services Provided
2.1 Push Button Hosting provides web hosting services, including but not limited to:
- Shared hosting services
- Website hosting space
- Email services
- Database services
- Technical support
- Domain registration services (where applicable)
2.2 Service specifications, including storage space, bandwidth, and other resources, are as detailed on our website and in your selected hosting plan.
## 3. Acceptable Use Policy
3.1 You agree to use our hosting services in compliance with all applicable laws and regulations.
3.2 Resource Usage:
- CPU usage shall not exceed allocated limits
- Memory usage shall remain within plan specifications
- Storage space usage must not exceed plan limits
- Bandwidth usage must remain within specified limits
3.3 You agree not to:
- Attempt to circumvent any resource quotas
- Execute background processes without authorization
- Run BitTorrent or other P2P applications
- Use the service for file storage or backup unrelated to website operation
- Conduct port scanning, packet sniffing, or other network interference
## 4. Prohibited Content
4.1 The following content and activities are strictly prohibited:
4.1.1 Illegal Content:
- Child exploitation material
- Terrorist-related content
- Content promoting hate speech or discrimination
- Unauthorized copyrighted material
- Malicious software or malware
- Phishing websites
- Content that violates any applicable laws
4.1.2 Adult Content:
- Pornographic material
- Sexually explicit content
- Adult services advertisements
- Escort services
4.1.3 Harmful Content:
- Spam content or spam distribution tools
- Hacking tools or instructions
- Botnets or related software
- DDoS tools or services
- Unauthorized data collection tools
4.1.4 Intellectual Property Violations:
- Pirated software
- Unauthorized streaming services
- Counterfeit goods sales
- Copyright-infringing content
- Trademark violations
## 5. Service Level Agreement and Uptime Guarantee
5.1 Uptime Commitment:
- We commit to maintaining 99.9% uptime for our hosting services
- This excludes scheduled maintenance windows
- Scheduled maintenance will be announced at least 48 hours in advance
- Emergency maintenance may be performed without notice when necessary
5.2 Service Credits:
- Service interruptions exceeding our uptime guarantee will be compensated with hosting credit
- Credits will be calculated based on the duration of service interruption
- Credits must be claimed within 30 days of the incident
- Credits cannot be converted to cash and are only applicable to future hosting services
## 6. Backup Policy
6.1 While we maintain regular backups of our systems:
- We recommend customers maintain their own backups
- We do not guarantee the availability or integrity of backups
- Backup restoration requests may incur additional fees
- Backups are maintained for 30 days unless otherwise specified
6.2 Backup Limitations:
- Backups are provided as a courtesy service
- Individual file restoration is not guaranteed
- Databases exceeding 2GB may not be included in routine backups
- Backup frequency varies by hosting plan
## 7. DMCA Compliance and Copyright Claims
7.1 We comply with the Digital Millennium Copyright Act (DMCA):
- Copyright infringement claims must be submitted according to DMCA requirements
- We will remove allegedly infringing content upon receipt of a valid DMCA notice
- Counter-notices will be processed according to DMCA procedures
- Repeat infringers will have their accounts terminated
7.2 DMCA Notices must include:
- Physical or electronic signature of the copyright owner
- Description of the copyrighted work claimed to be infringed
- Description of where the allegedly infringing material is located
- Contact information of the complaining party
- A statement of good faith belief in the infringement
- A statement of accuracy under penalty of perjury
## 8. Account Management and Security
8.1 Account Responsibilities:
- You are responsible for maintaining the security of your account credentials
- You must not share account credentials with unauthorized users
- You must maintain accurate contact and billing information
- You must promptly report any security breaches or unauthorized access
8.2 Resource Management:
- Accounts must remain within allocated resource limits
- Exceeding resource limits may result in service suspension
- Additional resources may be purchased as needed
- We reserve the right to require resource usage optimization
## 9. Payment Terms
9.1 Billing and Payments:
- All fees are payable in advance unless otherwise stated
- Payments are non-refundable except as specified in our refund policy
- Service may be interrupted if payment is not received by the due date
- We reserve the right to change pricing with 30 days notice
9.2 Payment Methods:
- We accept major credit cards and specified payment methods
- All payments are processed through secure payment processors
- Automatic renewal is enabled by default
- Failed payments may result in service suspension
9.3 Late Fees and Payment Penalties:
- Accounts overdue by more than 5 days will incur a late fee of $25 or 5% of the outstanding balance, whichever is greater
- Services will be automatically suspended if payment is not received within 15 days of the due date
- A reactivation fee of $50 may be charged to restore suspended services
- Accounts overdue by more than 30 days may be terminated and data deleted
- Outstanding balances may be sent to collections after 60 days
9.4 Refunds:
- 30-day money-back guarantee for new accounts
- Refunds are not provided for domain registration fees
- Partial month refunds are not provided
- Refunds may be denied in cases of Terms of Service violations
## 10. Account Suspension and Termination
10.1 We reserve the right to suspend or terminate services for:
- Violation of these Terms of Service
- Non-payment or payment disputes
- Excessive resource usage
- Security concerns or suspected illegal activity
- False or fraudulent information
- Hosting prohibited content
10.2 Termination Process:
- Notice will be provided when possible
- Immediate termination may occur for serious violations
- Customers have 7 days to backup their data after termination
- No refunds are provided for termination due to violations
10.3 Data Retention:
- Account data may be deleted upon termination
- Backups are maintained for 30 days after termination
- Data restoration fees may apply after termination
- We are not responsible for data loss after termination
## 11. Limitation of Liability
11.1 Service Limitations:
- Services are provided "as is" without warranties of any kind
- We do not guarantee continuous or uninterrupted service
- We are not liable for any data loss or business interruption
- We are not responsible for any indirect or consequential damages
11.2 Force Majeure:
- We shall not be liable for failures due to circumstances beyond our control
- This includes but is not limited to:
- Natural disasters
- Acts of war or terrorism
- Network or equipment failures
- Government actions
- DDoS attacks
- Civil unrest
11.3 Indemnification:
- You agree to indemnify and hold us harmless from any claims
- This includes legal fees and damages arising from your use of our services
- This covers violations of these Terms or any applicable laws
## 12. Changes to Terms
12.1 Modification of Terms:
- We reserve the right to modify these Terms at any time
- Changes will be effective upon posting to our website
- Continued use of services constitutes acceptance of modified Terms
- Material changes will be announced via email
- You are responsible for reviewing Terms regularly
## 13. General Provisions
13.1 Assignment:
- You may not assign your rights under these Terms
- We may assign our rights to any subsidiary or successor
- We may use third-party service providers to deliver services
13.2 Severability:
- If any provision is found invalid, the remaining Terms remain in effect
- Invalid provisions shall be replaced with valid ones of similar intent
- The failure to enforce any right does not constitute a waiver
## 14. Governing Law and Jurisdiction
14.1 These Terms are governed by the laws of the United States, State of Nevada.
14.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Clark County, Nevada.
14.3 You agree to submit to such jurisdiction for the resolution of any claims.
